Gym won't let me cancel within the cancellation period: who helps?
Summary
If you joined online or by phone, the law usually gives you a 14 day cooling off period to cancel. If you joined in person at the gym, there is no legal cooling off period, but a cancellation window written into your contract still binds the gym. Front desk staff cannot override the written terms. Cancel in writing before the window ends, keep proof, and if money is taken after that, ask your bank about the Direct Debit Guarantee or a chargeback.
Key information
- Online or by phone: the Consumer Contracts Regulations usually give 14 days to cancel a service. If you used the gym during that time, you may have to pay for what you used.
- In person: no automatic legal right, but if your contract gives a 10 day cancellation window, the gym must honour it.
- Written terms win: a verbal "minimum 3 months" does not override a written right to cancel.
- Proof: email the address in your contract and keep a copy. A recorded letter adds proof.
- Unfair terms: terms that are hidden or one sided may be unfair under the Consumer Rights Act 2015.
- Payments: cancelling a Direct Debit does not end the contract by itself, but once you have validly cancelled, you can stop payments and challenge wrong ones.
- The gym can: process a written cancellation through head office or member services, and confirm it. They will not usually let front desk staff cancel. Write to the contract address and head office.
- Your bank can: refund a Direct Debit taken in error under the Direct Debit Guarantee; consider a chargeback for card payments taken after you cancelled. They will not decide whether your contract was cancelled. Send them your proof.
- Citizens Advice can: explain your rights using cancelling a gym membership and changed your mind; pass a report to Trading Standards if a gym regularly ignores cancellations. They will not cancel for you or recover your money.
Practical guidance
- Read your contract and note the cancellation clause and its deadline.
- Email member services and head office today: "I am cancelling under clause X within the cancellation period. Please confirm."
- Keep a copy of the email and any reply. If no reply, send a recorded letter too.
- Once cancelled, tell your bank and challenge any later payments.
- If the gym still chases you, call the Citizens Advice consumer helpline.
- As a last step, claim any money owed through the small claims process.
- Ask the Shaman to order the steps for your case.
