Assault costs after police CPS delay: who helps?
Summary
If you were a victim of assault and face costs after the investigating officer failed to progress matters with the CPS, who helps is Victim Support for practical support, the Criminal Injuries Compensation Authority (CICA) for eligible injury awards, the police complaints system for service failures, and a personal injury solicitor for civil claims against the attacker (and only in rare cases against public bodies). These doors do different jobs. Advisers will not rewind the CPS decision as an appeal court on demand.
Key information
- Keep medical records, receipts, crime reference numbers, and every email with the officer.
- CICA is a statutory scheme with its own rules and time limits (GOV.UK CICA). It is not a general “refund my costs” desk. It will not pay every incidental cost or punish the police for delay.
- A police complaint is about service standards. It is not automatic compensation. Outcomes may include explanation, apology, or learning. It will not guarantee CPS charging or pay your private medical bills as a matter of course.
- Victim Support offers emotional and practical help and can help you navigate information about CICA (victimsupport.org.uk). They will not run a civil claim as your solicitor.
- Civil claims have limitation clocks. Get advice early if injuries or losses are serious.
