Ground rent reviewed every 10 years by RPI — what should a buyer check?

Summary

Many London flats still carry ground rent that rises over time, often by RPI (Retail Price Index: a legacy measure of UK inflation tracking the cost of goods and services, still used for index-linked bonds and wage negotiations despite being replaced by CPI as the official statistic in 2003) on a fixed review cycle (e.g. every 10 years). A “low” service charge does not cancel a high or escalating ground rent. Before exchange, get the lease terms checked by a conveyancer and use free leasehold advice services to understand what the numbers mean for lenders and long-term cost.

Key information

  • Ground rent is a rent payable under many long leases to the freeholder; it is separate from service charge.
  • Escalation can be fixed steps (e.g. doubling) or index-linked (commonly RPI). RPI reviews are common on post-2000 new-build leases.
  • From 30 June 2022, most new long residential leases in England are restricted to a peppercorn ground rent under the Leasehold Reform (Ground Rent) Act 2022. That does not automatically wipe ground rent on older (existing) leases.
  • Government has consulted on capping ground rents on existing leases; treat reform as policy in progress, not a guarantee for today’s purchase.
  • Lenders and valuers may flag high or escalating ground rents — your solicitor / conveyancer should raise this before you commit.

  • Your conveyancer / solicitor — ask them to explain the ground rent clause, review dates, RPI mechanism, and any lender issues; do not rely on the estate agent’s summary alone.
