Drone flying low over my back garden: who helps?
Summary
For a low flying camera drone over a private garden, who helps splits by problem type. Police (101) or CAA reporting for unsafe or illegal flying. The ICO for personal data and filming privacy when images or audio of people are captured. Citizens Advice for neighbour dispute framing. The ICO is a data protection regulator, not a drone ban agency, and it will often expect you to contact the operator first.
Key information
- Note dates, times, height estimates, whether a camera is visible, and whether the same pilot recurs.
- Unsafe flying (for example over crowds, near airports, above height limits, immediate danger) is a police / CAA safety issue first.
- Privacy and personal data concerns may engage UK GDPR / Data Protection Act rules when a drone records identifiable people, especially beyond a purely household activity.
- ICO path: identify the operator, write using the approach in the home CCTV template letter (adapt to drone camera), ask about filming beyond their property and whether they will stop or reposition, then consider subject access / object / erasure. Controllers usually have one calendar month to respond.
- After contacting the operator, you can raise a concern via the ICO’s home CCTV complaints style route. The ICO is clear there is a limited amount they can do against a private individual, and they are unlikely to force a home user to move equipment in many neighbour cases. Organisations using drones face stronger expectations (see UAS / drones guidance).
- The ICO will not seize the drone, ban recreational flying (that is CAA / police), attend your garden, guarantee deletion of every clip, or replace a harassment or nuisance claim in court.
- Citizens Advice helps separate safety / harassment (police) from data protection (ICO letter path). They will not contact the pilot for you or replace the ICO or police.
Practical guidance
- Log incidents: dates, times, height, camera visible, registration markings if any.
- Police 101: unsafe flying, harassment, immediate risk (999 if danger to life).
- CAA: privacy and illegal drone use.
- Operator in writing: adapt the ICO home CCTV template.
- ICO complaint: only after the operator route, understanding enforcement limits for domestic users.
- Citizens Advice: neighbour framing if you need a second opinion on which door fits.
- Ask the Shaman: free door routing.
