Dismissed in under two weeks with a baby at home: who helps?

Summary

If you were dismissed in under two weeks, ordinary unfair dismissal usually needs two years’ continuous service as an employee. That does not mean you have no rights. Notice pay, holiday pay, unpaid wages, discrimination, and some automatic unfair dismissal claims can still apply from day one. Who helps depends heavily on whether you were an employee, a worker, or on a zero hours / casual contract.

Key information

  • Under two years’ service, ordinary unfair dismissal is usually unavailable for employees, but check discrimination and automatic unfair dismissal from day one.
  • Employee: fullest rights set; before two years still claim unpaid wages, holiday, notice (if due), discrimination, or automatic unfair dismissal (for example pregnancy, whistleblowing, asserting a statutory right).
  • Worker (including many casual / agency style arrangements): National Minimum Wage, paid holiday, discrimination protection, and many payment rights if you qualify. Usually no ordinary unfair dismissal.
  • Zero hours: often worker or employee depending on facts; core rights still apply. Specialist help: Zero Hours Justice (zerohoursjustice.org, 01904 900 151).
  • Ask in writing for reasons, final pay, holiday pay, and notice pay. Keep offer letters, dismissal notes, and payslips.
  • ACAS early conciliation is still the gateway for many employment tribunal claims. Time limits are short (often three months less one day).
  • Citizens Advice helps identify employee versus worker versus zero hours, list money still due, explain which claims survive under two years, and point to ACAS. They will not usually be your full tribunal advocate or negotiate a settlement as your solicitor.
  • Speak to a solicitor sooner if dismissal may link to a protected characteristic, whistleblowing, unpaid final pay after chase, ACAS ending without agreement, or the deadline is close.

  • Employer / payroll: written request for reasons, P45, final pay, holiday, notice.
  • ACAS: dismissal guidance and early conciliation if you may claim (acas.org.uk, 0300 123 1100).
  • Zero Hours Justice if the role was zero hours or insecure.
  • Citizens Advice: status and pay rights overview; getting help with a problem at work.
  • Union / Maternity Action / Working Families / EASS if facts fit.
  • Solicitor / [Ask the Shaman](https://www.legalshaman.com/): when the triggers above apply. You usually do not need a solicitor on day one solely to ask payroll for holiday pay, but do not miss ACAS deadlines while you wait for a free appointment.
