Employer requires my personal phone for work: who helps?

Summary

If your employer insists you use your personal phone for work (apps, 2FA, WhatsApp groups, customer calls), who helps first is ACAS for workplace practice and grievance options, then your written grievance. The ICO only helps if the issue is personal data misuse, not simply “I dislike BYOD”. Citizens Advice can help you check employee versus worker status. None of them will buy you a work handset.

Key information

  • Check your contract and any BYOD or expenses policy for phone provision or allowance.
  • Note your status: employee, worker, zero hours, agency, or self employed. Remedies differ.
  • Separate “must install work apps” from monitoring of personal content. Monitoring has its own limits.
  • Keep screenshots of instructions to use your own device.
  • ACAS will explain raising issues informally then via grievance. They will not order the employer to supply a phone.
  • ICO handles data protection complaints about personal data. They will not decide employment disputes (ico.org.uk).
  • Citizens Advice helps with status check and letter structure. They will not negotiate with HR.

  • Manager / HR in writing: ask for a work device or clear expenses.
